The November Threshold: Fighting for Molecular Common Sense

On November 12, 2026, the hemp industry faces its most significant federal challenge since the 2018 Farm Bill. A new federal provision, often called "The November Change," threatens to redefine "hemp" in a way that ignores the biology of the plant.
At Simply Crafted, we believe in transparency—not just in our lab reports, but in the political landscape that affects your right to access wellness. Here is what you need to know about the 0.4mg cap and why we are fighting back.

1. The 0.4mg "Kill Switch"
The current federal proposal (CAEA) introduces a mathematical paradox. While it maintains the 0.3% Total THC limit for hemp, it adds a new restriction: a maximum of 0.4 milligrams of Total THC per container.
The Math of Nature: A single gram of high-quality, compliant CBD flower typically contains about 2mg to 3mg of Total THC. Under this new rule, a single pre-roll or a 3.5g bag would technically become a federally prohibited substance, despite being non-intoxicating and under the 0.3% threshold.
2. The Threat to "612 Strains" & Local Growers
This isn't just about what’s on our shelves; it’s about the Sovereignty of our local farmers. This rule would effectively ban the sale of hemp flower in its natural form across the United States. For a brand like Simply Crafted, rooted in the heritage of 612 Strains, this is an attack on the craft we have spent years perfecting. We believe that a plant produced by nature shouldn't be criminalized by an arbitrary decimal point.
3. The "Klobuchar Delay": A Path Forward
There is a bipartisan solution on the table. The Cannabinoid Safety and Regulation Act, supported by Minnesota’s own Senator Amy Klobuchar, seeks to delay these changes until November 2028.
This delay is a mechanical necessity. It allows the USDA and FDA time to create a permanent regulatory framework that protects consumers without bankrupting the thousands of small businesses and farmers that make up the Minnesota hemp ecosystem.
4. The Minnesota Safe Harbor
As we prepare to open Marvin’s Garden in Northeast Minneapolis, we are working closely with the Minnesota Office of Cannabis Management (OCM). Minnesota has led the way in creating a safe, regulated market. We are advocating for the OCM to maintain "Safe Harbor" status for state-licensed businesses, ensuring that our community continues to have access to tested, safe, and compliant flower regardless of federal gridlock.

Regardless of the outcome in November, the Simply Crafted Foundry is prepared.
