Everything You Need to Know About Minnesota’s New Hemp Laws

Minnesota’s new hemp laws are changing the way consumers access hemp-derived products.

Most importantly, HF 4065 impacts edible products containing THC, such as Delta-8, Delta-9, and Delta-10. Whether you’re a fan of Delta-8 or Delta-10 — Minnesota’s upcoming laws are about to change the way you experience hemp-derived THC edibles.

Below, we’ll discuss everything you need to know about HF 4065 and how it impacts the hemp industry in Minnesota.

What Does HF 4065 Do?

As of June 2nd, 2022, Governor Walz of Minnesota signed HF 4065 into law.

HF 4065 is a modified bill that’s about to make hemp-derived THC edibles legal. As you can imagine — this is big news for consumers and manufacturers in Minnesota.

Under the 2018 Farm Bill, hemp-derived products are already protected. However, HF 4065 clarifies the confusion surrounding edibles because the FDA has yet to clarify its stance.

However, HF 4065 goes further by making a stance on hemp-derived edible THC products, such as Delta-8, Delta-9, and Delta-10.

Specifically, all hemp-derived edible THC products must conform to specific requirements, such as:

• Each serving must not exceed 5mg

• Each product must not contain a maximum of 50mg

In other words, HF 4065 limits the amount of THC in hemp-derived products, such as Delta-10, Delta-9, and Delta-8 edibles.

Prior to HF 4065, hemp-derived THC manufacturers in Minnesota had to maintain their products at or below 0.3% THC. However, HF 4065 requires limited dose sizes and maximum THC content per package.

Aside from limiting the serving size and maximum allowable limit of THC — HF 4065 requires hemp consumers to be 21 or older.

From edibles to vape pens, all hemp consumers in Minnesota must be 21 and over. Prior to the bill, the minimum age for certain products was 18.

Is HF 4065 Good or Bad?

Ultimately, HF 4065 gives clarity to the entire hemp industry in Minnesota.

Although manufacturers and clients must adapt to new rules and regulations, the “gray zone” is no longer gray. In other words, consumers and manufacturers will benefit by having a better idea of what is legal or not.

However, HF 4065 negatively impacts those under 21 years of age. Most notably, products without THC content still need to meet the 21+ requirement. Overall, most hemp industry professionals are questioning the new age limit imposed by HF 4065.

When Does HF 4065 Go Into Effect?

HF 4065 does not take effect until August 1st, 2022.

After August 1st, 2022, all businesses that sell hemp-derived THC products, such as delta-8 or delta-10 edibles, must swap out their inventory for products that meet the new standards.

Therefore, customers have nearly a month and a half to take advantage of current laws to buy hemp-derived edibles. Furthermore, age restrictions will not begin until August 1st once the new law goes into effect.

Does HF 4065 Affect Smokable or Vapor-Based Hemp Products?

As the bill stands — no.

HF 4065’s primary agenda is to clear the confusion surrounding hemp-derived edibles. Once again, the FDA has yet to signal its stance on hemp-derived edibles.

Therefore, HF 4065 is taking matters into its own hands by creating clear guidelines for hemp-derived edible manufacturers. Therefore, hemp flowers and hemp-based vape cartridges are not included in the HF 4065.

Ultimately, HF 4065 is not a red alert for the hemp community in Minnesota. However, individuals under 21 can no longer purchase hemp-derived edibles regardless of their THC content.

Specifically, hemp-derived edibles that do not meet the 5mg serving size and 50mg maximum rule will no longer be available. However, they will be replaced with compliant products while remaining deliciously potent.
